COLORADO SPRINGS, Colo. (KKTV) – A 31-year-old woman who admits to having sex with a 13-year-old boy and later becoming pregnant with his child will face no jail time under a plea deal with prosecutors. .
Andrea Serrano of Fountain was facing sexual assault charges after her arrest in 2022, but she accepted this new plea deal to stay out of prison earlier this year.
Serrano gave birth to the baby after she admitted to having sexual relations with the 13-year-old boy. The victim’s mother told 11 News that she is not happy with the treatment offered to a woman who, according to her, ruined the life of her son.
“I feel like my son’s childhood is being stolen from him. He now has to be a father. He is a victim and he will have to live with it for the rest of his life,” the victim’s mother, whom we did not identify, told 11 News.
“I feel like if she was a man and he was a girl, she would definitely be different. They would be looking for more. I feel like because he’s not a woman, they’re not. They are having compassion for her,” said the victim’s mother.
Under the terms of the plea agreement reviewed by 11 News and signed by the suspect, Serrano will be required to register as a sex offender, and the judge could sentence her to 10 years in prison for life on intensive supervised sex offender probation. Serrano will avoid any jail time, as the district attorney’s office reduced the original charges to a lesser charge that does not carry mandatory jail time.
The victim’s family is also awaiting the next steps in this case. They plan to ask the courts to give the 13-year-old girl custody of the baby. Serrano currently has custody of the baby. Serrano will find out in May how long she will be on probation.
